Daily Talk Topics ("the App") is operated by Phi IT, a sole proprietor (eenmanszaak) based in Hoorn, the Netherlands ("we", "our", "us").
By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
You must be at least 13 years of age to use the App. By using the App, you represent that you meet this age requirement.
Daily Talk Topics is a mobile application that delivers conversation starters organized by category. Each day, a fresh set of categories and topics is made available.
Content is generated with the assistance of artificial intelligence and is intended for entertainment and social purposes only.
Pro subscriptions are available at the prices displayed in the App at the time of purchase. Prices may vary by region and are subject to change. Any price changes will apply to subsequent billing cycles, not the current active period.
Subscriptions renew automatically at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the end of the current period. Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period.
We may offer a free trial period for Pro subscriptions. If a free trial is available, it will be displayed on the subscription screen at the time of purchase. You will not be charged during the free trial period. At the end of the free trial, your subscription will automatically convert to a paid subscription and your Apple ID or Google Play account will be charged at the standard subscription rate unless you cancel at least 24 hours before the free trial ends. Free trial eligibility is determined by Apple or Google and is typically available only once per account.
All payments are processed by Apple (App Store) or Google (Google Play). We do not collect, store, or have access to your payment information.
If you lose access to your Pro subscription due to a device change, factory reset, or reinstallation, you can use the "Restore Purchases" feature in the App's settings. This feature verifies your original purchase through the App Store or Google Play and transfers your subscription to your current device. Restore Purchases is available as long as your subscription remains active or within its current billing period. Each subscription may be restored up to 5 times. If you have reached this limit, please contact support for assistance.
You can cancel your subscription at any time through your device's subscription settings:
After cancellation, you will retain access to Pro features until the end of your current billing period. Uninstalling the App does not cancel your subscription.
Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly. If you believe you are entitled to a refund, please contact Apple Support or Google Play Support.

We reserve the right, but not the obligation, to reject, modify, or remove any user-submitted content at our sole discretion.
All content in the App, including but not limited to conversation topics, categories, text, graphics, logos, and software, is the property of Daily Talk Topics or its licensors and is protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, reproduce, distribute, sell, license, or create derivative works from any content obtained through the App.

We may suspend or terminate your access to the App at any time, with or without cause and with or without notice. You may stop using the App at any time.
Upon termination, the following sections shall survive and remain in full force and effect: User-Submitted Content (Section 5), Intellectual Property (Section 6), Disclaimers (Section 8), Limitation of Liability (Section 9), Governing Law and Disputes (Section 13), Class Action Waiver (Section 14), Severability (Section 15), and EU Consumer Rights (Section 17).
The App and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Conversation topics are generated with the assistance of artificial intelligence and are intended for entertainment and social use only. We do not guarantee that topics are accurate, appropriate for all situations, or free from errors. Use your own judgment when using conversation topics in social settings.
The App does not provide legal, medical, psychological, relationship, financial, or other professional advice. If you need professional guidance on any topic, consult a qualified professional. You should not rely on any content in the App as a substitute for professional advice.
We do not warrant that the App will be available at all times, uninterrupted, secure, or error-free.
To the maximum extent permitted by applicable law, Daily Talk Topics and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
Our total liability for all claims related to the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
We strive to keep the App available at all times, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue the App or any part of it at any time, with or without notice.
If we discontinue the App entirely, active Pro subscribers will not be charged for subsequent billing periods. Cached content on your device may become unavailable or outdated.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your information.
The App relies on third-party services including Apple App Store, Google Play, RevenueCat, and Google AdMob. Your use of these services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or practices of third-party services.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through informal negotiation by contacting us at [email protected]. If informal resolution is not successful within 30 days, disputes shall be submitted to the competent courts of the Netherlands.
To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.
This waiver does not apply where prohibited by law. If you are a consumer residing in the European Union or European Economic Area, this section does not limit any mandatory rights you have under applicable consumer protection laws, including the right to participate in collective redress proceedings.
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from the remaining provisions and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.
We may update these Terms from time to time. Changes will be reflected by an updated effective date at the top of this page. We will notify you of material changes through the App or other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
If you are a consumer residing in the European Union or European Economic Area, nothing in these Terms shall limit or exclude any mandatory rights you have under the applicable consumer protection laws of your country of residence.
In the event of any conflict between these Terms and mandatory consumer protection laws applicable to you, the mandatory consumer protection laws shall prevail.
